Clear-State Terms of Use
1. General provisions
1.1. These Terms of Use (hereinafter - the "Terms") govern access to the AI product Clear-State (hereinafter - "Clear-State", "AI product", "product") and its use by users (hereinafter - the "User").
1.2. Clear-State is provided by LLC "KHMARKA", Registration code 39514910, registered office: 4B LITERA А, Verhniy Val str, Kyiv, Ukraine 04071, (hereinafter - the "Operator", "we", "us").
1.3. By using Clear-State, clicking the consent button, or continuing to interact with the product after reviewing these Terms, the User confirms that they have read, understood, and accept these Terms.
1.4. If the User does not agree to these Terms, they must not use Clear-State.
1.5. Clear-State is at the prototype stage. The functionality, availability, interaction format, and individual features of the product may change.
2. Product Description
2.1. Clear-State is an AI product for structured self-reflection in non-crisis life situations involving emotional tension.
2.2. Clear-State helps the User reflect on an emotionally complex life situation more calmly and consistently, better understand what exactly causes tension or inner discomfort, and consider the situation from different points of view.
2.3. In the course of interaction, Clear-State may ask clarifying questions, help explore thoughts, reactions, and perceptions of the situation, and offer short reflection exercises aimed at structuring experiences, reducing internal tension, and improving orientation regarding possible further actions.
2.4. The structure of interaction with Clear-State may be based on approaches used in cognitive behavioral therapy, in particular regarding work with interpretation of the situation, emotional reactions, anxious thoughts, and alternative ways of making sense of events. This does not mean that Clear-State provides psychotherapeutic, medical, or clinical services.
3. Limits of Use and Important Disclaimer
3.1. Clear-State is not psychotherapy, crisis, medical, psychiatric, or other professional assistance and does not replace seeking help from a qualified specialist.
3.2. Clear-State does not perform diagnostics, does not determine the user's mental or medical condition, does not form medical or clinical conclusions, does not prescribe treatment, and does not provide treatment recommendations.
3.3. Clear-State is not intended for use in situations of immediate danger, acute psychological crisis, risk of self-harm, suicidal thoughts, violence, threats to the life or health of the user or other persons, or in any conditions requiring urgent professional assistance.
3.4. If the User is in danger, intends to harm themselves or others, is experiencing an acute psychological crisis, or needs urgent assistance, they must immediately contact emergency services, crisis services, a doctor, psychotherapist, psychiatrist, or another qualified specialist.
3.5. The User independently assesses the appropriateness of using Clear-State in their situation. If the User has doubts about their condition or safety, they must choose professional assistance instead of using Clear-State.
4. Who May Use Clear-State
4.1. ClearState is intended for Users aged 18 and older.
4.2. Users who have not reached the age of 18 are not entitled to use Clear-State. If such a person gains access to Clear-State or uses it contrary to these Terms, such use is considered unauthorized and carried out without the Operator's consent. To the extent permitted by applicable law, the Operator is not liable for the consequences of such use, and responsibility for controlling a minor's access to Clear-State rests with their parents, legal representatives, or other persons who enabled or allowed such access. The Operator has the right to restrict or terminate access to ClearState if it becomes aware that the product is being used by a User who has not reached the age of 18.
4.3. The User confirms that they have sufficient legal capacity and capacity to act to accept these Terms or use Clear-State on another lawful basis.
5. Rules of Use
5.1. The User agrees to use Clear-State only for personal structured self-reflection in non-crisis situations.
5.2. The User must not:
a) use Clear-State as a substitute for psychotherapy, medical, psychiatric, crisis, or other professional assistance;
b) use Clear-State to make decisions regarding treatment, diagnostics, medication, hospitalization, or any urgent actions related to life or health;
c) knowingly enter content that is unlawful, harmful, discriminatory, violent, offensive, or infringes the rights of others;
d) attempt to gain unauthorized access to systems, data, models, infrastructure, or accounts related to Clear-State;
e) copy, modify, decompile, reverse engineer, or otherwise interfere with the operation of Clear-State, except in cases expressly permitted by law or by the Operator's written consent;
f) use Clear-State to create products or services that compete with Clear-State without the Operator's prior written consent;
g) use automated means for mass access, scraping, load testing, or data collection without the Operator's prior written consent.
5.3. The Operator may temporarily or permanently restrict the User's access to Clear-State if the User violates these Terms, creates risks to the security of the product, other users, or the Operator, or uses the product other than for its intended purpose.
6. AI Responses and User Responsibility
6.1. Clear-State uses artificial intelligence technologies. Clear-State's responses are generated automatically and may be incomplete, inaccurate, inappropriate, or may not take into account all circumstances of the user's specific situation.
6.2. Clear-State does not guarantee the achievement of any particular emotional, psychological, behavioral, or other result.
6.3. The User independently decides whether to use and how to interpret Clear-State's responses. Any subsequent actions of the user remain their own responsibility.
6.4. If a Clear-State response causes anxiety in the user, worsens their condition, or seems unsafe, the user must stop interacting with the product and contact an appropriate specialist or support service.
7. Personal Data and Confidentiality
7.1. The Operator processes personal data in accordance with the Clear-State Privacy Policy, available at: [----].
7.2. The User is advised not to provide excessive identifying or other sensitive personal data when interacting with ClearState, including full name, residential address, document numbers, financial information, exact place of work, data of third parties, medical documents, or other information that is not necessary to describe the situation.
7.3. Clear-State is not intended to request excessive identifying or sensitive personal data from the User. The interaction should be focused on describing the situation without excessive personalization.
7.4. If the User voluntarily provides personal or sensitive data, they understand that such data may be processed by the Operator to the extent necessary to provide, maintain, secure, and improve Clear-State, in accordance with the Privacy Policy and applicable law.
7.5. The User must not provide personal data of other persons without a proper legal basis or their consent.
8. Research and Prototype Stage
8.1. Clear-State is at the prototype and early-use stage. The functionality, interaction format, and individual features of the product may change.
8.2. If the Operator conducts testing, surveys, or scientific research, the User's participation in such activity is governed by separate information materials and, if necessary, a separate consent form. Ordinary use of Clear-State in itself does not mean that the User consents to participate in scientific research.
8.3. A reference to partner organizations, if any appears in Clear-State materials, does not mean that such organizations provide the User with psychotherapeutic, medical, psychiatric, or crisis assistance through Clear-State, unless this is expressly provided for by separate written terms.
9. Intellectual Property
9.1. All intellectual property rights to Clear-State, including the name, design, interface, texts, interaction structure, software code, product logic, materials, databases, and other elements of the product, belong to the Operator or are used by the Operator on lawful grounds.
9.2. The User is granted a limited, non-exclusive, non-transferable, and revocable right to use Clear-State in accordance with these Terms.
9.3. The User retains rights to the information they enter into Clear-State, unless otherwise provided by law or a separate agreement. At the same time, the user grants the Operator the right to process such information to the extent necessary to provide, maintain, secure, analyze, and improve Clear-State in accordance with these Terms and the Privacy Policy.
9.4. The User does not receive any rights to artificial intelligence models, software, prompts, system instructions, technical infrastructure, or other internal elements of Clear-State.
10. Availability, Changes, and Termination of Operation
10.1. Clear-State may be unavailable in whole or in part due to technical maintenance, updates, errors, limitations of third-party services, connection problems, or other circumstances.
10.2. The Operator may change, update, restrict, suspend, or terminate the operation of Clear-State in whole or in part, with or without notice to users, if this is necessary for product development, security, compliance with the law, or other justified reasons.
10.3. The Operator does not guarantee uninterrupted, error-free, or fully secure operation of Clear-State.
11. Cost of Use
11.1. Unless expressly stated otherwise in the Clear-State interface or separate terms, use of Clear-State at the prototype stage may be provided free of charge.
11.2. If the Operator introduces paid features, a subscription, or other payments, the relevant terms, price, payment procedure, cancellation, and refunds must be communicated to the User before the purchase or activation of the paid feature.
12. Third-Party Services
12.1. Third-party technologies, artificial intelligence services, hosting, analytics, security tools, or other providers may be used for the operation of Clear-State.
12.2. The Operator may transfer or provide access to data to such providers only to the extent necessary for the operation of Clear-State, in accordance with the Privacy Policy, agreements with such providers, and applicable law.
12.3. The Operator is not responsible for unavailability or failures of third-party services if such failures are beyond the Operator's reasonable control.
13. Limitation of Liability
13.1. Clear-State is provided "as is" and "as available", without warranties of fitness for a particular purpose, error-free operation, continuity, accuracy, or achievement of a specific result, except for warranties that cannot be excluded under the law.
13.2. To the extent permitted by applicable law, the Operator is not liable for:
a) decisions or actions of the user made on the basis of Clear-State responses;
b) use of Clear-State in crisis, medical, psychiatric, or other situations for which the product is not intended;
c) indirect, incidental, special, punitive damages, loss of data, profit, reputation, or other similar losses;
d) harm caused by the User providing inaccurate, incomplete, excessive, or sensitive information;
e) failures, unavailability, or errors caused by actions of third parties, third-party services, the Internet, or force majeure circumstances.
13.3. Nothing in these Terms limits the User's rights that cannot be limited or excluded under applicable law.
14. Indemnification
14.1. The User agrees to compensate the Operator for reasonable damages, expenses, or third-party claims arising as a result of the user's breach of these Terms, unlawful use of Clear-State, or infringement of third-party rights.
15. Changes to the Terms
15.1. The Operator may update these Terms from time to time.
15.2. A new version of the Terms enters into force from the moment of its publication or from another date specified in the new version.
15.3. If the user continues to use Clear-State after the updated Terms enter into force, this means acceptance of such changes.
16. Governing Law and Dispute Resolution
16.1. These Terms are governed by the laws of Ukraine, unless otherwise expressly provided by mandatory provisions of applicable law.
16.2. The Parties will attempt to resolve any disputes, disagreements, or claims through negotiations and correspondence at the Operator's contact address.
16.3. If the dispute cannot be resolved through negotiations, it shall be considered by a competent court in accordance with the laws of Ukraine.
